At Walker Trial Lawyers, we represent real people who have been victims of police abuse, brutality, excessive and deadly force, misconduct and negligent tactics resulting in injury and death.  WTL lawyers will not hesitate to file a federal lawsuit on your behalf and bring your case before a jury seeking an award of compensatory damages and punitive damages for your injuries against a sheriff department or police agency for violations of your civil rights.  Civil rights cases prosecuted by our lawyers include cases involving allegations of false arrest and detention, excessive force by beating, unlawful use of deadly force, unlawful use of tasers, unlawful officer involved shooting and other causes of injury, pain, suffering and death.

Section 1983 of the Civil Rights Act of 1871 provides those injured by a police officer or sheriff deputy a way to seek recovery of injuries, harms and damages.  That section provides: “Every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress. …”

The primary purpose of Section 1983 of the Civil Rights Act is to provide a way to enforce the 14th Amendment to the Constitution’s protections of citizens against police or sheriff negligent tactics, misconduct and abuse, brutality, excessive or deadly force by shootings, tasers and beatings, as well as unlawful arrests and detentions.

Our attorneys will help you recover compensatory damages for your harms and injuries.  “Compensatory damages” are intended to redress the actual loss that you have suffered by the excessive force or abuse of authority by a police officer or sheriff deputy.

In addition to compensatory damages for your injuries, our lawyers will seek an award of punitive damages under Section 1983 if a police officer, deputy sheriff or law enforcement agency is proven to be motivated by evil motive or intent or that the police officer or sheriff deputy acted recklessly or with callous indifference to your civil rights.
